OUR POLICIES

Impact Volleyball Club is a Christ-centered volleyball program operated under West Coast Impact Athletic League, a 501(c)(3) nonprofit. The documents below govern your use of our website and participation in our programs.

Terms of Service

Welcome to Impact Volleyball Club (“IVC,” “we,” “us,” “our”), a Christ-centered, family-oriented volleyball program operated under West Coast Impact Athletic League, a 501(c)(3) nonprofit organization. These Terms of Service (“Terms”) govern your access to and use of our website, www.impactvolleyballclub.net (the “Site”), and your participation in our volleyball programs and related services (collectively, the “Services”).

1. Acceptance of Terms

By accessing our Site or registering for our Services, you, on behalf of yourself and any minor athlete you register (a “Participant”), agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

2. Eligibility and Registration

Our programs are open to youth athletes who meet the specific age and eligibility criteria outlined for each team and program level. To register a Participant for our Services, you must be their parent or legal guardian. By registering a Participant, you represent and warrant that you have the legal authority to agree to these Terms on their behalf. You agree to provide accurate, current, and complete information during the registration process and to keep this information updated.

3. Code of Conduct

IVC is a Christ-centered organization founded on principles of integrity, respect, and sportsmanship. All Participants, parents, guardians, coaches, and spectators are expected to adhere to the following Code of Conduct:

  • Demonstrate respect for all players, coaches, officials, volunteers, and property, reflecting Christian values in all interactions.
  • Refrain from unsportsmanlike conduct, including foul language, bullying, harassment, and any form of physical or verbal abuse.
  • Abide by the rules of the sport and the decisions of officials.
  • Encourage a positive, supportive, and God-honoring team environment.

Failure to comply with this Code of Conduct may result in disciplinary action, including suspension or removal from our programs without refund, at our sole discretion.

4. Fees and Payments

All fees for participation, uniforms, tournament entry, and other services are determined by factors such as team level, tournament schedule, and equipment costs and are due according to the payment schedule established for each season. Participation in practices and tournaments is contingent upon full payment of all fees. Payments are processed through a secure third-party payment processor via the Crossbar platform. Please review our Refund Policy, available on our Site, for information regarding refunds.

5. Assumption of Risk and Waiver of Liability

Participation in volleyball and related athletic activities involves an inherent risk of significant injury. By registering a Participant for our Services, you acknowledge and agree to the following:

Assumption of Risk: You understand and voluntarily assume all risks associated with participation in volleyball, including but not limited to sprains, strains, fractures, concussions, joint injuries, and other serious personal injuries, including permanent disability or death.

Waiver and Release: On behalf of yourself, the Participant, and your respective heirs, assigns, and next of kin, you hereby release, waive, and discharge Impact Volleyball Club, West Coast Impact Athletic League, their respective directors, officers, employees, coaches, volunteers, and agents from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant while participating in any IVC activity or using its facilities.

6. Medical Treatment Authorization

In the event of a medical emergency during an IVC-sanctioned event where you cannot be reached, you authorize IVC and its representatives to seek and consent to emergency medical treatment for the Participant as deemed necessary by licensed medical personnel. You agree to be financially responsible for any and all costs associated with such medical treatment.

7. Use of Name and Likeness

You grant Impact Volleyball Club and West Coast Impact Athletic League the perpetual, royalty-free right to use the Participant’s name, image, and likeness in photographs, videos, and other recordings for promotional, archival, and other purposes related to IVC’s non-profit mission, without compensation. These materials may appear in print, on our website, on social media, or in other promotional materials.

8. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is the property of IVC, West Coast Impact Athletic League, or their licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content from the Site without our prior written permission.

9. Third-Party Links and Services

Our Site utilizes and contains links to third-party websites and services, including the Crossbar sports management platform for registration and third-party payment processors. We are not responsible for the content, security, or privacy practices of these external sites. Your use of third-party sites is at your own risk and subject to their respective terms and policies.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. IMPACT VOLLEYBALL CLUB AND WEST COAST IMPACT ATHLETIC LEAGUE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SERVICES OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IMPACT VOLLEYBALL CLUB, WEST COAST IMPACT ATHLETIC LEAGUE, THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR INABILITY TO USE OUR SERVICES OR FROM PARTICIPATION IN OUR PROGRAMS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Impact Volleyball Club, West Coast Impact Athletic League, their respective directors, officers, employees, coaches, and volunteers from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with the Participant’s participation in the Services, your use of the Site, or your violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the revised Terms on the Site and update the “Effective Date.” Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Sacramento County, California, and the parties hereby consent to the personal jurisdiction and venue therein.

Impact Volleyball Club (“IVC,” “we,” “us,” “our”) is a Christ-centered, family-oriented volleyball program operated under West Coast Impact Athletic League, a 501(c)(3) nonprofit organization. We are committed to providing youth athletes in the Sacramento region with competitive volleyball programs in a faith-based environment. A. Personal Information You Provide to Us: When you register an athlete, sign up for newsletters, volunteer, or otherwise contact us, we collect information such as:

  • Parent/Guardian Information: Full name, mailing address, email address, and phone number.
  • Athlete Information: Full name, date of birth, age, and gender.
  • Emergency and Health Information: Emergency contact names and phone numbers, and any medical information relevant to an athlete’s safe participation in volleyball (e.g., allergies, medical conditions).
  • Communications: Any information you provide when you contact us with questions or feedback.

B. Payment and Transaction Information: All payments for registration fees, tournament fees, uniforms, and other services are processed through secure, third-party payment processors. We do not directly collect, store, or have access to your full credit card numbers or financial account information. We only receive transaction confirmations and details necessary to verify payment.

C. Information Collected Automatically (Usage Data): When you visit our Site, we automatically collect certain technical information, including your Internet Protocol (IP) address, browser type, operating system, and browsing behavior (such as pages visited and time spent on the Site). This information helps us maintain and improve our Site’s functionality.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide and Manage Our Programs: To process registrations, create team rosters, manage tournament and practice schedules, and facilitate participation in our volleyball programs.
  • To Communicate With You: To send important updates about schedules, practices, tournaments, and other club-related events. We may also send newsletters and announcements about IVC. You may opt out of non-essential communications.
  • For Health and Safety: To ensure our coaches and staff have the necessary medical and emergency contact information to respond appropriately in the event of an injury or medical emergency.
  • For Administrative and Legal Purposes: To maintain our operational records, comply with legal and regulatory obligations (including our 501(c)(3) status under West Coast Impact Athletic League), and enforce our policies.

4. How We Share Your Information

We are committed to protecting your privacy and do not sell your personal information. We may share your information in the following limited circumstances:

  • With Service Providers: We share information with third-party vendors who perform services on our behalf. This primarily includes Crossbar, our sports management platform, which handles online registration and stores participant data; and Payment Processors, secure third-party services that process registration fees and payments.
  • With Coaches and Club Officials: We share necessary participant information (e.g., name, medical information, emergency contacts) with coaches, team managers, and authorized club officials for the sole purpose of managing teams and ensuring player safety.
  • With Our Parent Organization: As a program of West Coast Impact Athletic League, certain administrative data may be shared with the parent organization for compliance, financial, and operational purposes.
  • As Required by Law: We may disclose information if required to do so by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect the safety of our participants, the public, or IVC.

5. Children’s Privacy (COPPA Compliance)

Our Services are intended for youth athletes, including children under the age of 13. We are committed to complying with the Children’s Online Privacy Protection Act (COPPA).

Parental Consent: We do not knowingly collect personal information from a child under 13 without obtaining verifiable consent from their parent or legal guardian. During registration, a parent or guardian must create the account and provide the child’s information. This action constitutes verifiable parental consent.

Information Collected from Children: We collect only the information reasonably necessary for a child to participate in our programs, as described in Section 2.

Parental Rights: Parents and guardians of children under 13 have the right to:

  • Review the personal information we have collected from their child.
  • Request that we delete their child’s personal information.
  • Refuse to permit the further collection or use of their child’s information.

6. Your California Privacy Rights

As a California-based organization, we provide California residents with the rights afforded to them under the California Online Privacy Protection Act (CalOPPA) and the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

  • Right to Know/Access: You have the right to request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which we use it, and the categories of third parties with whom we share it.
  • Right to Delete: You have the right to request the deletion of your personal information, subject to certain exceptions (e.g., information needed to complete a transaction, comply with legal obligations, or ensure the safety of our participants).
  • Right to Correct: You have the right to request the correction of inaccurate personal information we hold about you.
  • Right to Opt-Out: We do not sell or share personal information for cross-context behavioral advertising, so there is no need to opt out.
  • Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

Impact Volleyball Club (IVC) is a Christ-centered, family-oriented volleyball program operated under West Coast Impact Athletic League, a 501(c)(3) nonprofit organization. In accordance with federal law and the requirements of the Internal Revenue Service (IRS), Impact Volleyball Club and its parent organization, West Coast Impact Athletic League, maintain a racially non-discriminatory policy.

Impact Volleyball Club admits students and athletes of any race, color, and national or ethnic origin to all the rights, privileges, programs, and activities generally accorded or made available to students at the organization and in its athletic programs.
